Dear All Members, I need a bit of advice not sure what to do next?? I was refused DLA so I wrote to them asking for a 'statement of reasons' and also for my claim to be looked at again. They sent me a statement of reasons which didn't tell me 'actually' the reason for the refusal, I then received letter to say that the original decision was correct, and that is will remain refused, and that I can appeal within 1 month. Seems they don't actually look at the points in the form, I have also provided diaries and how I get by day to day. Would I be better approaching the CAB to help me with the appeal??? can anybody help???? Thanks Michelle.

Hi Michelle,
Sorry to hear you have been turned down for DLA.
I totally agree with you that they don't even bother to read the forms.
I would say yes, definitely get the advice of the CAB if you can and they will help you through the appeal.

Hello,
I had the same problem and got it on appeal. Today I have been talking to CAB and they are monitoring the way the DWP are dealing with claims. They told me to contact the Community Law Service who will take your appeal through all the stages with you. They might be worth trying. If you want the number I was given let me know.

this might help No Ans a yes Ans no Ans a no ans and write about your worst day only may not say well i am a little better that does not come into it . Get some one to do it for you who knows what they are doing as when i had the forms done for me the second time the lady not so good so the ans where not what they where looking for .So i had it stoped . may be think how you are going to tell them what to write the worst . christine The chocolate eating housewife ...The washer woman .....naughty lady

Hi Michelle,
I have found after many years of completing DLA forms for mental health service users that there is no correct way to complete the form. Chrissie is right, you should approach the form by writing how you feel on your worse day. Now, having thought myself as being a bit of an expert in completing these forms one would of thought I would have achieved first time round a successful DLA claim: not so! Despite having provided loads of evidence: reports from consultants, GP, physio, and OT, I was turned down.
Upon receiving a negative response, I telephoned and asked for a review/reconsideration of the decision and stated the reasons why, suggesting that they had not looked at the evidence or taken expert opinion into account. It seemed to have worked for me, and did not have to appeal or go to tribunal. The best thing that I can advise, is to ask for a review, submitting further evidence/reports from health care professionals, and then if all fails, approach your local CAB to assist you with an appeal.

Michelle, So sorry you are having to go through all this pallaver ! NRAS do a booklet designed to help you apply for DLA. I think you can download it from the website. If not, they will send you a copy. It is very helpful. Don't give up, so many of us have been refused in the first instance (I wonder if they just refuse as a matter of course ). The CAB idea is a very good one, many people have been successful after they have been involved. Don't give up - keep going and learn to be very objective about your condition. When you are successful, your DLA will be back-dated to the date you asked for the forms. Good luck. Ann "I cannot do everything. I accept that. Hi Michelle
I was also refused DLA,i was devasted although my husband was amazingly calm.I went to my GP to see if it was worth appealing,he thought it was.I also told him just how bad i felt and took my sister in who really told him how it was.They changed there mind after i wrote them a letter explaining how i felt on my worst day.They contacted my GP again and it was also his report that changed it all. I was back payed all the money.

morning. I had to go through this with DLA - I appealed and went to tribunal. We won and got a nice lump sum at the end (as all the money was back dated) I was almost ready to give up when they sent the pack of all the details as they tell of cases that look very bad but yet failed tribunal but the SW who looked after my care said to go for it. NO ONE he knows with a genuine need gets turned down at tribunal. this was with many yrs experience. the CAB helped too, saying even if I didnt get through they would help me just apply again. The wording on the forms is important and words like unpredictably, frequently together with all your evidence is spot on. Avocacy groups also help with these forms.
